Two Suspects Arrested, Charged in Fatal Shooting at 10100 Sapling Way

Charges have been filed against two suspects arrested in the fatal shooting of a man at 10100 Sapling Way about 3:40 p.m. on January 19.

One suspect, Kenneth Vasquez, 34, is charged with capital murder in the 185th State District Court.  A booking photo of Vasquez is attached to this news release.

The other suspect, 15, is being referred to Harris County Juvenile Probation authorities on the same charge.  Booking photos of juvenile suspects are not releasable.

The males are accused for their roles in the killing of Osvaldo Leyva, 76.

HPD Homicide Division Sergeant C. Ponder and Detective K. Stringer reported:

HPD patrol officers responded to a shooting call at the above address and found Mr. Leyva unresponsive with multiple gunshot wounds.  Houston Fire Department paramedics responded to the scene and transported Leyva to Ben Taub General Hospital where he was pronounced deceased.

A preliminary investigation indicated Leyva was robbed and shot by two unknown Hispanic male suspects.  The suspects are believed to have committed other robberies in the area prior to the shooting.

Further investigation led to the identities of Vasquez and a juvenile male as the two suspects.  Vasquez was arrested on Jan. 24 and charged with murder for his role in a separate fatal shooting of a man at 9707 South Gessner Road about 8:05 a.m. on January 11.

On Wednesday (February 28), Vasquez was also charged with murder for his role in this fatal shooting on Sapling Way.
