HOUSTON - Charges have been filed against a third suspect arrested in the fatal shooting of a man that occurred at 1511 Wirt Road about 10:15 p.m. on May 3, 2016.
The suspect, David Ochoa (H/m, 23), is charged with capital murder in the 174th State District Court.
Two other suspects, Anibal Hernandez (H/m, 21) and Angel Rivera (H/m, 29), are charged with capital murder in the same court.

A fourth suspect, Abraham Grimaldo, 21, was pronounced dead at the scene. The victim, Eric Torres, 24, was also pronounced dead at the scene.
HPD Homicide Division Sergeants J. Horn, J. Brooks, C. Cegielski and Officers S. Overstreet and M. Arroyo reported:
HPD patrol officers responded to a shooting call at the Sonic restaurant at the above address and found one male (Torres) in the driver's seat of his vehicle with several gunshot wounds. HFD paramedics pronounced him deceased. Officers were then notified by Memorial Hermann Memorial City Medical Center personnel of another gunshot wound victim (Grimaldo) brought to the hospital by two unknown acquaintances, who left without providing any information.
Further investigation determined the victim (Torres) had arranged to meet the suspects at the above location to conduct a narcotics transaction. The suspects arrived and parked their blue Honda Accord behind Torres' vehicle, blocking him in the drive-in stall. Hernandez, armed with an AR-15, and Grimaldo exited backseat of the Accord with the intent to rob Torres. Torres, armed with a handgun, realized he was about to be robbed and fired several shots, striking Grimaldo several times. Hernandez fired the AR-15 several times, killing Torres. Hernandez and Rivera then placed Grimaldo in the Accord and took him to the hospital where he died from his wounds.
A large amount of marijuana and pills, as well as Torres' pistol, were recovered at the scene.
The investigation initially identified Hernandez and Rivera as suspects in this case and, on August 25, 2016, they were arrested without incident.
Further investigation identified Ochoa as a suspect in this case and on Wednesday (April 12), he was taken into custody without incident.
