HPD Homicide Division Sergeant M. Burrow and Detectives C. Sharp and E. May reported:

On September 27, HPD homicide detectives opened an investigation into the suspicious disappearance of Ms. Kirby, who had not been seen since September 18.  On October 3, Texas Equusearch recovered human remains in a field near Bear Creek Park in the 16000 block of Patterson Road.  An autopsy by the Harris County Institute of Forensic Sciences later identified the remains as Emmishae Kirby.

Further investigation and evidence obtained by detectives indicated Gilbert was with Kirby on the night of her death and determined he was responsible for her disappearance and death.

Gilbert was taken into custody on Wednesday (January 20) and subsequently charged for his role in Kirby’s death.
