Suspect Arrested, Charged in Shooting Incident at 4000 Westheimer Road

Charges have been filed against a suspect arrested in an incident in which HPD officers discharged their duty weapons at 4000 Westheimer Road about 7:30 p.m. on Monday (July 6).

The suspect, Jamarcus Oneal Spates, 30, is charged with unauthorized use of a motor vehicle in the 482nd Criminal District Court. A booking photo of Spates is attached to this news release.

HPD Sergeant D. Levine and Officers C. Gutierrez, E. Day, J. Torres, S. Santos, J. Mejia, O. Barrera, M. Carter and M. Bueno, who all discharged their duty weapons, were not injured in this incident.  They were sworn in January 2016, July 2025, July 2025, January 2023, November 2024, November 2024, February 2020, March 2021 and December 2019 respectively.

HPD Homicide Special Investigations Unit Sergeants E. Wohlgemuth and M. Glover reported:

An off-duty uniformed officer working extra employment at a business at the above address spotted a suspicious vehicle parked at the above address.  Upon further investigation it was found the vehicle had been reported stolen out of Fort Bend County and was also related to an assault.  Uniformed, on-duty Houston police officers arrived at the location and attempted to perform a felony traffic stop on the parked vehicle.  The suspect inside the vehicle refused multiple commands to exit the vehicle and remained inside for an extended period of time.

Officers then made a coordinated approach toward the vehicle, at which time officers believed the suspect pushed open the driver’s door and extended his arm in a shooting position.  Officers discharged their duty weapons and the suspect was grazed with a bullet.

As is customary in HPD officer-involved shooting incidents in the city limits, the case is being investigated by the HPD Special Investigations Unit, the Internal Affairs Division and the Harris County District Attorney’s Office.
