| Charges have been filed against a suspect who fired shots at Houston police officers at 9253 Opelika Street about 8:30 p.m. on Wednesday (January 5).
The suspect, Joshua Shawn MaGee (w/m, 21), is charged with three counts of aggravated assault against a peace officer and one count of manufacturing/delivery of a controlled substance in the 209th State District Court. A booking photo of MaGee is not available at this time, as he remains hospitalized.
Four HPD officers discharged weapons during the incident: Sergeant M. Lopez and Officers J. Seay, C. Overstreet and E. Holland, assigned to the HPD Tactical Operations Division, were sworn in as officers in December 2001, November 2006, September 2009 and July 2005, respectively.
HPD Special Investigations Unit Sergeant G. Rodgers and Detectives S. Mohajer, E. Rossow and I Ulloa reported:
HPD SWAT officers were at the above address to execute a felony arrest warrant on MaGee for an unrelated December 2021 aggravated assault incident. Several individuals were detained outside the residence and confirmed MaGee was inside. SWAT officers surrounded the residence, knocked on the door and announced their presence for several minutes.
After receiving no response, SWAT officers made entry to the residence and searched for MaGee. As officers made their way through a hallway, MaGee unexpectedly confronted them at gunpoint and fired multiple shots. Officer Seay was struck in the left cheek area by shrapnel from the gunfire. Fearing for their lives, four SWAT officers discharged their duty weapons and retreated from the residence. MaGee then barricaded himself in the residence. It was unknown at that time if he had been struck by the gunfire.
After several hours of negotiations, HPD SWAT officers attempted unsuccessfully to get MaGee to exit the residence. SWAT officers then used a tactical “bobcat” to force entry to the residence, at which time MaGee fired additional rounds at officers. Using less-lethal means, MaGee was taken into custody. He was found to have suffered non-life-threatening injuries and was transported by paramedics to Memorial Hermann Greater Heights Hospital.
As is customary in HPD officer-involved shooting incidents in the Houston city limits, this case is being investigated by the HPD Special Investigations Unit and the Internal Affairs Division.
