| Charges have been filed against a suspect shot by a Houston police officer after he assaulted the officer at 4400 North Freeway (North Interstate Highway 45) service road about 7:25 p.m. on Sunday (June 26).
The suspect, Phillip D. Rogers, 41, is charged with assault of a peace officer, aggravated assault with a deadly weapon and disarming a police officer in the 232nd State District Court. A booking photo of Rogers, who is hospitalized, is not available for release at this time.
HPD Officer J. Pavlica, who discharged his duty weapon, was transported to Memorial Hermann-Texas Medical Center, where he was treated and released. Officer Pavlica was sworn in as an officer in December 2014 and is assigned to the North Patrol Division.
HPD Special Investigations Unit Sergeant J. Young and Detectives C. King, D. Hammons, M. Childs and H. Le reported:
Officer Pavlica was off-duty and working an approved extra job at a business at the above address when Rogers entered the store armed with a large wooden table leg. Rogers approached a male patron he had never met and told him, “get out of my store,” and struck the patron twice in the head. Rogers then walked away from the business. The officer was notified of the incident by store employees and he followed Rogers as he left.
The officer attempted to stop Rogers, but he ran toward a restaurant in the same shopping center at 19 East Crosstimbers Street. At that time, the officer attempted to deploy his Conducted Energy Device (CED) on Rogers, but the suspect was able to forcibly take the officer’s CED. The officer and Rogers struggled over the CED and the suspect struck the officer over the head multiple times until the officer was able to create distance between himself and the suspect. Fearing for his safety, the officer discharged his weapon and the suspect was struck. Rogers ran from the location and was taken into custody by other responding HPD officers at a nearby business. Rogers was transported by Houston Fire Department paramedics to an area hospital in stable condition. He was subsequently charged for his role in the incident.
As is customary in HPD officer-involved shooting incidents in the Houston city limits, this case is being investigated by the HPD Special Investigations Unit, the Internal Affairs Division and the Harris County District Attorney’s Office.
