2nd UPDATE: Second Suspect Arrested, Charged in Fatal Shooting at 8524 Gulf Freeway 

Charges have been filed against a second suspect arrested in the fatal shooting of a man at 8524 Gulf Freeway (South Interstate Highway 45) service road about 3:45 a.m. on October 13.

The suspect, Dominic Griffin, 17, is charged with capital murder in the 487th State District Court. A booking photo of Griffin is attached to this news release.

The other suspect, Jimmie Wayne Daniels, 21, is charged with capital murder in the 487th State District Court. A booking photo of Daniels is also attached to this news release.

Both suspects are accused in the killing of Roberto Almaguer Garza, 29.

HPD Homicide Division Sergeant M. Wilson and Detectives M. Castillo, M. Nicotra and K. Clark reported:

HPD patrol officers responded to a shooting at a gas station at the above address and found Mr. Almaguer Garza suffering from multiple gunshot wounds.  Houston Fire Department paramedics responded to the scene and pronounced him deceased.

A preliminary investigation determined Almaguer Garza was the owner of a food truck and a male suspect attempted to rob him at gunpoint.  During the robbery, a scuffle ensued, during which Almaguer Garza was shot multiple times.  The suspect fled the scene on foot in an unknown direction.

Further investigation identified Daniels, who was already in custody for unrelated felony incidents, as the suspect. On October 26, he was charged for his role in this fatal shooting.

Subsequent investigation identified Griffin as a suspect in this incident and he was charged on November 9.  Today (Nov. 16), Griffin was arrested without incident.
